TERMS AND CONDITIONS
General Terms and Conditions of Sale
1/ Definition
These General Terms and Conditions of Sale (hereinafter “GTC”) are submitted to its customers (hereinafter “the customer”) by the company HAPPY CRUISE IN PARIS (hereinafter “company”), SAS with capital of €1,000 and registered in the Nanterre Trade and Companies Register under number 982 163 180, whose head office is located at 8 Bis avenue des Mimosas, 92100 Boulogne Billancourt.
2/ Application and enforceability of the GTC
The purpose of these GTC is to define all the conditions under which the company markets its services, as offered to customers on its website www.happycruiseparis.com.
3/ Description of the services.
The company Happy Cruise in Paris offers private cruises on the Seine to discover Paris and its monuments. On board one of its boats, the company offers to discover the wonders of Paris along the water in a private setting.
Embarkation and disembarkation are exclusively from the port of the barge of the “Hélice Club de France”, located in Saint Cloud - 1363 quai Marcel Dassault - 92100.
The company's skippers have all the accreditations necessary to practice this profession (River license, Special passenger certificate, Restricted radiotelephony certificate) and significant experience in river navigation and passenger transport.
4/ Prices and payment conditions
The prices are mentioned on the website www.happycruiseparis.com in the description of the cruises and are mentioned in euros and all taxes included. The prices indicated include :
- the mobilization of the boat,
- the skipper
- the gasoline
- refreshments on board
Any additional request for service will be the subject of an additional proposal and will be invoiced in addition to the order.
Reservations are made in 3 possible ways :

Reservations are only considered effective when two conditions are expressly met :
- The company must first confirm the availability of the requested cruise and undertakes to respond to any reservation request within 48 hours
AND
- the full amount of the cruise must be paid. Without full payment of the cruise price, it cannot be confirmed by Happy Cruise in Paris, which cannot guarantee the availability of the boat for the chosen time slot.
Once the reservation is confirmed, the company will send the customer a summary email containing the date, number of passengers, meeting place and duration of the chosen cruise.
The price of each cruise cannot be reduced if the number of passengers is lower than that planned at the time of booking. However, in the event of additional passengers, an additional cost may apply from the 6th passenger, as indicated in the cruise descriptions.
Prices do not include: any tips, transport to the meeting place and additional services ordered before or during the cruise.
5/ Payment methods : Bank transfer, online payment, credit card, cash
6/ Cancellation conditions (withdrawal, cancellation, interruption, postponement, delay)
Withdrawal period: the customer has a legal withdrawal period of 14 days from the date of their order. In the event of cancellation at the customer's initiative, within this regulatory period, the order is then fully refunded.
Please note that in the event of a delay of less than 14 days between the order and the service, the cancellation conditions below apply.
Cancellation conditions :
- Cancellation at the request of the customer :
For any cancellation at the request of the customer, the latter must send the company a formal “Cancellation request” email to the following address: happycruiseinparis@gmail.com.
The refund conditions in the event of cancellation are calculated as follows :
- Cancellation up to D-7 (168 hours) before the cruise: full refund of the cruise ;
- Cancellation between D-7 and 24 hours before the cruise: 50% refund of the cruise ;
- Cancellation < 24 hours before the cruise: no refund will be possible.
Request for postponement:
Any request for postponement at the initiative of the customer must be the subject of a written request at least 48 hours before the scheduled cruise, indicating the planned time slot. In any event, only one postponement will be possible.
The company undertakes to do what is necessary, in good faith, and to use all means to find an arrangement with its customer in order to offer them other time slots allowing them to take their cruise and, as such, subscribes to a commitment of means.
In the absence of an alternative solution found between the parties, the reimbursement conditions will apply as defined.
Cancellation at the request of the company Happy Cruise in Paris
Any cancellation at the request of the company Happy Cruise in Paris will be subject to a proposal to postpone the cruise, or if such a postponement is not possible (due to the customer or the company), the cruise will be fully reimbursed.
River navigation in Paris is subject to strict regulations and specific one-off constraints. The company undertakes to comply with all of these regulations, restrictions and notices issued by the navigation authorities, which may in fact lead to the cancellation of a service.
The safety of our customers is an absolute priority for the Happy Cruise in Paris company. As part of the execution of the service, the skipper is the sole master on board to judge that the safety of his passengers is ensured, whether it is a question of weather conditions, navigation conditions, flow of the Seine or any other event involving a potential risk. In this case, he may decide to cancel the cruise under any circumstances.
Interruption :
In the event of a request for early return to port at the customer's request, the service will be billed in full and cannot give rise to a request for reimbursement.
Disembarkation :
The skipper reserves the right to disembark passengers if he considers that their behavior endangers the boat and its passengers or if they do not respect the skipper's instructions.
Delay
In the event of a delay by the customer(s), the return time cannot be changed and the cruise duration will therefore be reduced without any compensation being requested by the customer.
7/ Complaint
In the event of a complaint, it must be made in writing and sent within a maximum of 15 days after the cruise, by registered letter with acknowledgment of receipt, to the company's head office: 8 bis avenue des Mimosas 92100 Boulogne Billancourt.
8/ Responsibilities
The Happy Cruise in Paris company has taken out civil liability insurance with the Helvetia company, which covers all of its activities.
The company cannot be held responsible for any loss/breakage of its customers' personal effects on board the boat during the cruise.
For their part, the customer is responsible for any damage caused by them on board the boat and must reimburse all costs incurred in the event of damage/loss of objects belonging to the company.
The customer further declares to be in full possession of his faculties and to have the physical condition necessary to participate in a river cruise.
9/ Special conditions
Passengers must arrive at the waiting point at least 15 minutes before the scheduled departure time. Any request for pick-up/drop-off at a location other than the one planned must be the subject of a specific request and may result in additional costs for the customer.
The maximum capacity of the boat is 8 passengers, up to a limit of 650 kg. The boat is in its optimal configuration for up to 6 passengers, beyond that, movement on board and comfort are reduced.
Children on board under 16 must wear a life jacket at all times and must be under the constant supervision of their parents or other adults accompanying them.
The facilities and the boat are not suitable for people with reduced mobility. The people concerned must imperatively inform the company in order to check the feasibility of the cruise.
10/ Prohibitions
Animals are not accepted on board our boats
It is strictly forbidden to carry on board the boat any weapon, ammunition, explosives, fireworks, flammable, toxic or dangerous substances.
Access to the boat will be prohibited to any person visibly intoxicated or behaving in a manner that could endanger the boat and its passengers.
If any of these conditions are not met, the cruise may be cancelled, without a refund request being made.
11/ Force majeure
The company cannot be held responsible for an event falling within a case of force majeure (natural disaster, climatic event, severe weather, sudden flood, navigation accident with another responsible vessel or any other event beyond its control and which could not reasonably have been foreseen at the time of booking.
12/ Applicable law
In the event of a dispute, French law alone will apply.
