Terms and Conditions of Sale

1/ Definition

These Terms and Conditions of Sale (hereinafter referred to as “T&Cs”) are provided to clients (hereinafter referred to as “the client”) by the company HAPPY CRUISE IN PARIS (hereinafter referred to as “the company”), a SAS with a share capital of €1,000, registered with the Nanterre Trade and Companies Register under number 982 163 180, with its registered office located at 8 Bis avenue des Mimosas, 92100 Boulogne-Billancourt, France.

2/ Scope and Enforceability of the T&Cs

These T&Cs define all the conditions under which the company offers its services, as presented to clients on its website : www.happycruiseparis.com.

3/ Description of Services

Happy Cruise in Paris offers private cruises on the Seine River, allowing clients to discover Paris and its landmarks. Onboard one of its boats, the company provides a unique opportunity to explore the beauty of Paris in a private setting.

Boarding and disembarkation take place exclusively at the Hélice Club de France port, located in Saint-Cloud – 1363 quai Marcel Dassault – 92100.

The company’s skippers hold all the required licenses and certifications to perform their duties (River license, Special Passenger Certificate, Restricted Radiotelephony Certificate) and have significant experience in river navigation and passenger transportation.

4/ Prices and Payment Terms

Prices are listed on the website www.happycruiseparis.com in the cruise descriptions and are expressed in euros, inclusive of all taxes.

The prices include :

  • use of the boat,

  • the skipper,

  • fuel,

  • refreshments on board.

Any additional service request will be subject to a separate quote and will be invoiced in addition to the original order.

Reservations can be made in three ways :

Reservations are only confirmed once the following two conditions are met :

  • The company must first confirm the availability of the requested cruise and commits to respond within 48 hours.
    AND

  • The full payment of the cruise must be received. Without full payment, the reservation cannot be confirmed, and the company cannot guarantee the availability of the boat for the requested time slot.

Once the booking is confirmed, the company will send a summary email including the date, number of passengers, meeting point, and duration of the cruise.

The price will not be adjusted downward if fewer passengers attend than originally booked. However, if there are additional passengers (starting from the 6th person), an additional fee may apply, as indicated in the cruise descriptions.

Prices do not include: gratuities, transportation to the departure point, or any additional services ordered in advance or during the cruise.

5/ Payment Methods

Bank transfer, online payment, credit card, or cash.

6/ Cancellation Policy (withdrawal, cancellation, interruption, rescheduling, delay)

Right of withdrawal :
The client has a legal 14-day withdrawal period starting from the date of the order. If the cancellation is made within this legal period, the order will be fully refunded.

Please note : If the cruise is scheduled within less than 14 days of the booking, the cancellation policy below applies.

Cancellation by the client :
All cancellations must be submitted in writing via email to happycruiseinparis@gmail.com with the subject “Cancellation Request”.

Refund conditions are as follows :

  • Cancellation up to 7 days (168 hours) before the cruise: full refund.

  • Cancellation between 7 days and 24 hours before the cruise: 50% refund.

  • Cancellation less than 24 hours before the cruise: no refund.

Rescheduling request :
Any rescheduling request must be submitted in writing at least 48 hours before the cruise, including the desired new time slot. Only one rescheduling is allowed.

The company will make every effort, in good faith, to offer an alternative solution, committing to a best-effort obligation.

If no alternative can be found, the refund terms outlined above will apply.

Cancellation by Happy Cruise in Paris :
In case of cancellation initiated by the company, a rescheduling will be offered. If rescheduling is not possible (by the client or the company), the cruise will be fully refunded.

River navigation in Paris is subject to strict regulations and specific temporary constraints. The company commits to respecting all rules and notifications issued by the navigation authorities, which may result in cancellations.

The safety of our clients is a top priority. The skipper has full authority on board to assess and decide whether the cruise can proceed safely, considering weather, river conditions, water flow, or any other risk. In such cases, the cruise may be canceled at any time.

Interruption :
If the client requests to return to port before the end of the cruise, the full price remains due, and no refund will be issued.

Disembarkation :
The skipper reserves the right to disembark any passenger whose behavior endangers the boat or other passengers or who fails to comply with the skipper’s instructions.

Delay :
In case of client delay, the return time cannot be modified, and the duration of the cruise will be shortened accordingly. No compensation will be given.

7/ Complaints

Any complaint must be submitted in writing and sent by registered mail with acknowledgment of receipt within 15 days of the cruise to the company’s head office: 8 Bis avenue des Mimosas, 92100 Boulogne-Billancourt, France.

8/ Liability

Happy Cruise in Paris holds civil liability insurance with Helvetia covering all its activities.

The company cannot be held responsible for any loss or damage to clients’ personal belongings during the cruise.

The client is responsible for any damage they may cause on board and must reimburse the full cost of any repairs or replacements of damaged/lost company property.

The client also confirms that they are in good health and have the physical ability to participate in a river cruise.

9/ Special Conditions

Passengers must arrive at the meeting point at least 15 minutes before the scheduled departure time.

Any request for pick-up or drop-off at a location other than the specified port must be submitted in advance and may incur additional costs.

The maximum capacity of the boat is 8 passengers, up to a total of 650 kg. The boat is most comfortable with up to 6 passengers; above this, onboard movement and comfort are reduced.

Children under 16 must wear a life jacket at all times and remain under the supervision of their parents or accompanying adults.

The boat and its facilities are not adapted for passengers with reduced mobility. Any such passengers must inform the company in advance to assess feasibility.

10/ Prohibitions

Animals are not allowed on board.

It is strictly forbidden to bring onboard any weapons, ammunition, explosives, fireworks, flammable, toxic, or dangerous substances.

Access to the boat will be denied to any person visibly intoxicated or whose behavior may pose a risk to the boat and its passengers.

If these rules are not followed, the cruise may be canceled without the possibility of a refund.

11/ Force Majeure

The company cannot be held responsible for events considered force majeure (natural disasters, extreme weather conditions, sudden flooding, navigation accidents caused by third parties, or any event beyond its control and unforeseeable at the time of booking).

12/ Governing Law

In the event of a dispute, French law shall be the only applicable law.
